Terms of Use
These Terms of Use govern your access to and use of Nollyflix, including the Nollyflix website, applications, video streaming services, movie rentals, purchases, account features and any other services made available through the Nollyflix platform.
Nollyflix is operated by Fortress Studios Ltd, Lagos, Nigeria. By creating an account, purchasing or renting content, or otherwise using Nollyflix, you agree to these Terms of Use.
1. The Nollyflix Service
Nollyflix is a Video-On-Demand (VOD) and Pay-Per-View (PPV) streaming platform that provides access to Nollywood films, television programmes, original productions, documentaries and other African entertainment content.
Content available on Nollyflix may change from time to time. The availability of a particular movie or programme may also depend on licensing rights, your location, technical requirements or other restrictions.
2. Your Account
You may be required to create a Nollyflix account before purchasing, renting or accessing certain content.
You are responsible for maintaining the confidentiality of your login details and for all activity carried out through your account.
You agree to provide accurate and current information when creating or updating your account. You must notify us promptly if you believe your account has been accessed or used without your permission.
Nollyflix may suspend or restrict an account where we reasonably believe there has been fraud, unauthorized access, misuse of the service or a violation of these Terms.
3. Renting Movies
When you rent a movie on Nollyflix, you receive a limited right to stream that movie through your Nollyflix account for the rental period displayed at the time of purchase.
Unless otherwise stated on the platform, rented movies are available for 48 hours.
After the applicable rental period expires, access to the rented content will automatically end unless you rent or purchase the content again.
4. Purchasing Movies
When you purchase a movie on Nollyflix, you are purchasing access to stream that movie through your Nollyflix account. You are not purchasing ownership of the copyright or any other intellectual property rights in the movie.
Unless otherwise stated at the time of purchase, purchased movies may remain available through your account for up to 12 months (one year).
At the end of the applicable access period, renewal or another purchase may be required to continue accessing the content.
Purchasing content does not give you the right to reproduce, redistribute, resell, publicly perform, broadcast or commercially exploit that content.
5. Payments
Prices for rentals and purchases will be displayed before you complete your transaction.
Nollyflix may support payment methods such as debit or credit cards, bank payments or other payment options provided through approved payment processors.
By completing a transaction, you authorize the applicable payment provider to process the amount displayed at checkout.
Payment processing may be handled by third-party payment providers. Nollyflix does not require you to provide payment card information directly to us where the transaction is processed securely by a payment provider.
Your bank, card issuer or payment provider may charge additional transaction, currency conversion or other fees. Such charges are controlled by your payment provider and are not charges imposed by Nollyflix.
6. Refunds
Except where required by applicable law, completed movie rentals and purchases are generally non-refundable once access to the content has been provided.
If you are unable to access content because of a verified technical or transaction problem on the Nollyflix platform, please contact our support team. We will review the issue and, where appropriate, provide technical assistance, restore access, issue a credit or provide another appropriate remedy.
7. Personal and Non-Commercial Use
Nollyflix content is provided solely for your personal and non-commercial entertainment.
Nollyflix grants you a limited, non-exclusive, non-transferable and revocable right to access and stream content made available to your account.
You must not:
- Copy, reproduce or redistribute Nollyflix content;
- Record, download or capture content except where Nollyflix expressly provides a download feature;
- Resell, sublicense or commercially exploit Nollyflix content;
- Use Nollyflix content for public screenings or exhibitions without authorization;
- Circumvent digital rights management, security or content protection systems;
- Share access to purchased or rented content in a manner not permitted by Nollyflix;
- Reverse engineer, interfere with or attempt unauthorized access to the Nollyflix platform;
- Use automated systems, scraping tools, bots or similar technologies to access the service without permission; or
- Use Nollyflix for unlawful, fraudulent or abusive purposes.
8. Intellectual Property
The Nollyflix platform, including its branding, software, graphics, interface, logos, text and other platform materials, is owned by or licensed to Fortress Studios Ltd and is protected by applicable intellectual property laws.
Movies, television programmes and other audiovisual works available through Nollyflix remain the intellectual property of their respective copyright owners and licensors.
Nothing in these Terms transfers ownership of any Nollyflix content or intellectual property to you.
9. Content Availability
Some content may only be available in certain countries or territories due to licensing and distribution arrangements.
We may add, remove or change content available through Nollyflix where required by licensing arrangements, legal requirements or business considerations.
Where reasonably possible, we will seek to avoid disrupting access to content that has already been purchased or rented, subject to applicable licensing rights and legal requirements.
10. Streaming Quality and Internet Access
Streaming quality may vary depending on your device, internet connection, network conditions, location and the format in which the content is available.
You are responsible for the cost of your internet connection and any mobile data or other charges incurred while using Nollyflix.
Nollyflix does not guarantee that every movie will be available in every resolution or on every device.
11. Supported Devices
Nollyflix may be accessed using supported internet-connected devices, browsers and applications.
Features and functionality may differ depending on your device, operating system, application version or browser.
12. Service Availability
We aim to keep Nollyflix available and functioning reliably. However, the service may occasionally be interrupted for maintenance, updates, technical problems, network failures or circumstances outside our reasonable control.
We may update, modify or improve the Nollyflix platform from time to time.
13. Suspension and Termination
We may suspend or terminate access to Nollyflix where a user materially violates these Terms, engages in fraud, attempts unauthorized access, infringes intellectual property rights or uses the platform in a way that may harm Nollyflix, its users, creators or partners.
Where appropriate, we may provide notice or an opportunity to resolve the issue before terminating access.
14. Third-Party Services
Nollyflix may use third-party services for payments, authentication, analytics, communications, video delivery or other platform functions.
Your use of certain third-party services may also be subject to the terms and privacy policies of those providers.
15. Privacy
Our collection and use of personal information is governed by the Nollyflix Privacy Policy.
By using Nollyflix, you acknowledge that information may be processed as described in our Privacy Policy and in accordance with applicable data protection laws.
16. Disclaimer
Nollyflix is provided on an "as available" basis. While we take reasonable steps to maintain the reliability and security of the platform, we cannot guarantee that the service will always operate without interruption, delay or technical error.
Nothing in these Terms excludes or limits any rights or remedies that cannot lawfully be excluded under applicable consumer protection or other laws.
17. Limitation of Liability
To the extent permitted by law, Nollyflix and Fortress Studios Ltd will not be responsible for indirect or consequential losses arising solely from circumstances beyond our reasonable control.
Nothing in these Terms limits liability where such limitation would be prohibited by applicable law.
18. Changes to These Terms
We may update these Terms from time to time to reflect changes to the Nollyflix service, our business practices, applicable laws or regulatory requirements.
Where a change materially affects your rights, we will take reasonable steps to notify you before the updated Terms take effect.
Your continued use of Nollyflix after updated Terms become effective constitutes acceptance of the revised Terms, subject to applicable law.
19. Electronic Communications
You agree that Nollyflix may send account-related communications electronically, including purchase confirmations, rental confirmations, security notices, payment information, password notifications and changes to our policies or Terms.
20. Governing Law
These Terms of Use are governed by the laws of the Federal Republic of Nigeria.
Any dispute arising from or relating to the Nollyflix service will be handled in accordance with applicable Nigerian law and the jurisdiction of the appropriate Nigerian courts, subject to any rights you may have under applicable consumer protection laws.
21. Severability
If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
